You must not access or use the website if you are not an authorised user, if your authority has ceased or been suspended, or if your use of the website would breach any law, licence condition, contractual restriction or professional obligation.

8. Adviser Use of Website and Platform

This section applies to financial advisers, their authorised representatives, and any persons accessing or using this website or any associated MetLife platform or portal in connection with the provision of financial services to customers. The reference to Adviser in this clause shall be to each of those individuals and the Licensee shall be responsible for their conduct.

(a) Prohibition on Changing Customer Contact Information. An Adviser must not alter, substitute, redirect, or otherwise change any customer’s contact information (including but not limited to postal address, email address, telephone number, or other contact details) held on this website or any MetLife platform to the Adviser’s own contact details or to any contact details other than the customer’s verified personal contact information. Any such change must be made only at the express written direction of the relevant customer and in accordance with MetLife’s applicable policies and procedures. An Adviser who becomes aware of any unauthorised change to customer contact information must notify MetLife immediately.

(b) Data Integrity and Accuracy. An Adviser must ensure that all information submitted, entered, or modified on this website or any MetLife platform in respect of a customer is true, accurate, complete, and up to date. An Adviser must not enter false, misleading, or inaccurate information, and must not make any changes to customer records except as properly authorised by the relevant customer and permitted by applicable law.

(c) Security and Access Credentials. An Adviser is responsible for maintaining the confidentiality and security of any login credentials, passwords, or access tokens issued to the Adviser for use on this website or any MetLife platform. An Adviser must not share, disclose, or permit the use of their access credentials by any unauthorised person. The Adviser must notify MetLife immediately if they become aware of any actual or suspected unauthorised access to, or use of, their credentials or any MetLife platform.

(d) Acceptable Use. An Adviser must use this website and any MetLife platform solely for the purposes for which access has been granted, including the provision of financial services to customers and the management of insurance policies. An Adviser must not use this website or any MetLife platform for any purpose that is unlawful, fraudulent, or that may cause damage, disruption, or impairment to MetLife’s systems or services. An Adviser must comply with all applicable laws, regulations, and industry codes of conduct, including the Corporations Act 2001 (Cth), the Privacy Act 1988 (Cth), and any conditions imposed by the Australian Securities and Investments Commission or the Australian Prudential Regulation Authority.

(e) Delegates, Staff and User Management. Where MetLife permits delegate access, the primary adviser, relevant licensee or nominated account administrator is responsible for ensuring that each additional user is properly authorised, appropriately trained, and granted only the access reasonably necessary for that person’s role. An Adviser must ensure that delegated users, support staff and administrators comply with these Terms & Conditions and any applicable guidance issued by MetLife. An Adviser remains responsible for all acts and omissions of any person who accesses or uses the website under their account, authority, entity or supervision. An Adviser must promptly remove, restrict or update user access where a person changes role, no longer requires access, ceases to be authorised, leaves their business, or where continued access creates a security, privacy or compliance risk.

(f) Confidentiality. An Adviser must treat all customer information, MetLife proprietary information, and any other confidential information accessed through this website or any MetLife platform as strictly confidential. An Adviser must not use, disclose, or permit the disclosure of any such information except as necessary for the provision of financial services to the relevant customer, as required by law, or as otherwise authorised by MetLife in writing.

(g) Client Information, Authority and Instructions. Where an Adviser uploads, inputs, accesses, amends or otherwise manages any client or prospective client information, the Adviser warrants that they have obtained all necessary authorities, consents, permissions and instructions required by law and by their professional and contractual obligations. MetLife may rely on information and instructions submitted through the website, including those submitted through an authorised account or delegate access profile, unless MetLife has actual notice that reliance is not appropriate.

(h) Suspension and Termination of Access. MetLife reserves the right to suspend or terminate an Adviser’s access to this website or any MetLife platform at any time, without prior notice, if MetLife reasonably suspects that the Adviser has breached any of these Terms & Conditions, has engaged in conduct that is fraudulent, unlawful, or otherwise detrimental to MetLife or its customers, or for any other reason at MetLife’s sole discretion. Suspension or termination of access does not limit or waive any other rights or remedies available to MetLife at law or in equity.

(i) Legal and Regulatory Compliance. An Adviser is solely responsible for ensuring that their access to and use of this website or any MetLife platform, and any advice, instructions, communications, submissions or transactions made through it, comply with all applicable laws, licence conditions, regulatory requirements, codes, standards and professional obligations. This includes obligations relating to financial services, disclosure, design and distribution, anti-money laundering and counter-terrorism financing, sanctions, privacy, confidentiality, cyber security, electronic transactions, consumer laws, record keeping and client authority requirements. If an Adviser uses the website on behalf of a licensee, authorised representative, corporate authorised representative or other business, the Adviser represents and warrants that they have authority to do so and to bind that entity in relation to their use of the website.

If you are an Adviser, this indemnity extends to any claims arising from your handling of customer information, any unauthorised changes to customer records, and any breach of your obligations under section 8 of these Terms & Conditions. This indemnity survives termination of these Terms & Conditions and your access to this website.

11. Electronic Delivery and Records

To the extent permitted by law, you consent to receiving policy, operational, regulatory, service and system-related documents and notices electronically, including through this website or by links sent to your nominated contact details. You are responsible for ensuring that your contact details are current, your inboxes and systems can receive communications from MetLife, and that you regularly monitor your nominated email address and this website for notices and updates. These Terms & Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal therefrom in respect of any proceedings arising out of or in connection with these Terms & Conditions or the use of this website.

15. No Waiver

A failure or delay by MetLife to exercise any right, power or remedy under these Terms & Conditions does not operate as a waiver. A single or partial exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy.

16. Severability

If any provision of these Terms & Conditions is held to be invalid, illegal or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect to the maximum extent permitted by law.

17. Assignment

You must not assign, novate, transfer or otherwise deal with your rights or obligations under these Terms & Conditions without MetLife’s prior written consent. MetLife may assign, novate, delegate or subcontract any of its rights or obligations in connection with this website at any time, to the extent permitted by law.

18. Amendments

MetLife may amend these Terms & Conditions at any time by publishing updated Terms & Conditions on this website or otherwise notifying you electronically. The amended Terms & Conditions take effect from the date specified by MetLife or, if no date is specified, from the date of publication.
